To restore an exoneree's basic rights and assist his or her assimilation back into society.
BE IT ENACTED BY THE SENATE OF GIRLS NATION ASSEMBLED.
SECTION 1. TITLE
This act may be cited as the "Expungement of Exonerees' Criminal Records Act".
SECTION 2. PURPOSE
The Expungement of Exonerees' Criminal Records Act will result in the destruction of the exonerees' criminal records immediately upon exoneration in order to help the exoneree's assimilation back into society.
SECTION 3. DEFINITIONS
An exoneree is a person who has been wrongly convicted of a crime and is later exonerated, or proven innocent and cleared of all charges.
Expungement of criminal records is the destruction of criminal records from all databases other than those specified within this bill.
SECTION 4. EXPUNGEMENT OF THE EXONERATED'S CRIMINAL RECORDS ACT
The Expungement of Exonerees' Criminal Records Act entails that:
(A) The U.S. federal government will pass and sign into law legislation requiring that:
(1) All current and future exonerees will receive automatic destruction of all records maintained by all criminal justice agencies as well as the sex offender registry that directly pertain to the exoneree's erroneous arrest and conviction.
(2) An exoneree is legally allowed to answer "no" on any application that asks about previous arrests or convictions, without being subject to perjury.
(3) The federal court will retain and seal a private record of the conviction and will only be allowed to open the record with the consent of the exonerees for the purpose of proving the expungement.
SECTION 5. EFFECTIVE DATE
This act shall be effective for all past, present, and future persons exonerated in the federal criminal justice system beginning January 1, 2014.
