To allow the transfer of Guantanamo Bay detainees to the United States to the Department of Defense prisons for fair trial.
IN THE SENATE OF GIRLS NATION
Senators Espero and Seo of Nevada introduced the following bill; which was referred to Committee .
BE IT ENACTED BY THE SENATE OF GIRLS NATION ASSEMBLED.
SECTION 1. TITLE
This act may be cited as the "Guantanamo Bay Human Rights Protection Act".
SECTION 2. PURPOSE
With the ultimate goal of closing down the Guantanamo Bay detention camp to end human rights violations and to ensure that the detainees' rights to fair trial are protected, the Act will relocate the detainees to the six United States Department of Defense prisons.
SECTION 3. DEFINITIONS
Article 10 of the Universal Declaration of Human Rights states that "everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him."
SECTION 4. GUANTANAMO BAY HUMAN RIGHTS PROTECTION ACT
The Guantanamo Bay Human Rights Protection Act entails that
(A) Guantanamo Bay shall be shut down on January 1st, 2015.
(B) Any detainees who as of effective date are detained shall be transferred to the
six Department of Defense prisons that are located on active military bases
that are not open to the general public and are only at 48 percent capacity.
(C) In compliance with Article 10 of the Universal Declaration of Human Rights
And ubsequent human rights conventions, even under military detention,
detainees shall undergo due process and receive fair trial in the United States
(D) All net monetary benefits shall be placed back to general funds.
(E) Any laws in conflict with this act, including sections 1022 and 1027 under the
National Defense Authorization Act of 2013 which prohibit the use of funds
to transfer detainees and house the detainees in the United States, are hereby
SECTION 5. EFFECTIVE DATE
This act shall be on or after January 1st, 2015.
